These Terms and Conditions govern your use of Nunes Enterprise services and the purchase of shipping containers from our company. By placing an order or using our services, you agree to be bound by these terms.
By accessing our website, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are purchasing on behalf of a company, you represent that you have authority to bind that entity to these terms. If you do not agree with any part of these terms, you must not use our services.
Nunes Enterprise sells new and used shipping containers in various sizes and conditions. All product descriptions, specifications, and images on our website are approximate and for general information purposes. Actual containers may vary slightly in dimensions, color, and appearance. Used containers will show normal wear including surface rust, dents, and previous shipping markings, which do not constitute defects. We reserve the right to limit quantities, discontinue products, or modify specifications without prior notice.
All prices are listed in US Dollars and are subject to change without notice. Prices do not include applicable taxes, delivery fees, or additional services unless explicitly stated. Sales tax will be calculated based on your delivery location. Payment is due in full at the time of order unless other arrangements have been approved in writing. We accept major credit cards, ACH transfers, wire transfers, and approved company checks. Orders are not processed until payment is verified.
Your order constitutes an offer to purchase products according to these terms. Order placement does not guarantee acceptance. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or credit verification issues. Order confirmation emails acknowledge receipt but do not constitute acceptance. Acceptance occurs when we process payment and confirm container availability.
Delivery is provided according to our Shipping Policy. Delivery dates are estimates only and not guaranteed. Risk of loss and title pass to you upon delivery at your designated location. You are responsible for ensuring proper site preparation and access for delivery vehicles. Failed deliveries due to customer site issues will incur redelivery fees. Someone 18 or older must be present to accept delivery.
New containers come with a one-year limited warranty covering structural integrity and weather-tightness from manufacturing defects. Used containers are sold with a 90-day wind and watertight guarantee. Warranties do not cover normal wear and tear, cosmetic issues, damage from misuse or modifications, improper foundation or support, or condensation from inadequate ventilation. To claim warranty service, contact us with photos and description within the warranty period.
To the maximum extent permitted by law, Nunes Enterprise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from your use of our products or services. Our total liability shall not exceed the purchase price of the specific product giving rise to the claim. These limitations apply regardless of the legal theory under which the claim is brought.
You agree to indemnify and hold harmless Nunes Enterprise, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use or misuse of containers, violation of these terms or applicable laws, modifications you make to containers, injuries or property damage occurring on your property, or your failure to obtain necessary permits or approvals.
Containers must be used for lawful purposes only. You are responsible for compliance with all applicable laws, regulations, building codes, and permit requirements. Containers are not designed for human habitation without proper modifications meeting building codes. You may not use containers for storing hazardous materials without proper certification and safety measures. Any modifications void certain warranty provisions.
All content on our website, including text, images, logos, and designs, is the property of Nunes Enterprise or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission. Our trademarks may not be used without authorization.
Your use of our services is subject to our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
Any disputes arising from these terms or your use of our services shall be governed by the laws of the State where our headquarters is located, without regard to conflict of law provisions. You agree to submit to the jurisdiction of the state and federal courts in that location. Any legal action must be commenced within one year after the cause of action arises.
We reserve the right to modify these terms at any time. Changes become effective when posted on our website. Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.
